Refund Policy

1. About this Policy

1.1 Part of the Terms. This Refund Policy forms part of, and must be read together with, the nonaAi Terms of Service (the “Terms”). Words defined in the Terms have the same meaning here. “nonaAi”, “we”, “us” and “our” mean Advanced Technologies — A General Trading and Contracting Co. (Commercial Registration No. 85757), Abdullah Al Mubarak Street, Qibla, Block 9, Yousef M. Y. Alroomi Building, Floor 4, Office 3, Kuwait City 13083, Kuwait, the provider of the Services.

1.2 Scope. This Policy applies to every Subscription, trial and payment made for the Services through our website at nonaai.ai. It does not apply to anything you pay to a provider of an Agent or other Third-Party Service; those payments are governed solely by that provider’s terms, and we cannot refund them.

1.3 Your agreement. By starting a trial or a Subscription you confirm that you have read this Policy and agree to it.

2. Who processes your order

2.1 Merchant of Record. Our order process is conducted by our online reseller Paddle.com (“Paddle”). Paddle is the Merchant of Record for all our orders. Paddle takes your payment, issues your invoice, and handles returns and refunds on our behalf.

2.2 Paddle’s terms. Paddle’s own terms for buyers apply to your purchase in addition to this Policy. Where a refund is due under this Policy, it is made through Paddle.

3. The free trial

3.1 Fourteen days, free. A new Subscription begins with a free trial of fourteen (14) days. The trial gives you the Paid Features at no charge so that you can evaluate the Services before you pay anything.

3.2 Payment method required. A valid payment method is required to start the trial. It is not charged during the trial. A temporary authorisation may appear on your statement while your payment method is verified; it is not a charge.

3.3 Automatic conversion. Unless you cancel before the trial ends, your Subscription converts automatically to a paid Subscription at the end of the trial, and your payment method is charged the price shown to you when you started the trial. The price, the date of the first charge, and the fact that the Subscription renews automatically are shown to you at checkout and in your Account.

3.4 Cancelling during the trial. If you cancel before the trial ends, no charge is made and there is nothing to refund. Your access to the Paid Features ends when the trial ends, or earlier if stated at the time you cancel.

3.5 One trial. A trial is available once per person and per payment method.

3.6 The trial is your evaluation period. Because you are able to use the Services in full, free of charge, for fourteen days before any payment is taken, the first payment and every later payment are non-refundable as Section 4 provides.

4. Payments are non-refundable

4.1 The rule. Except as expressly provided in this Policy or in the Terms, or where required by applicable law, all payments are final and non-refundable.

4.2 What this covers. The rule applies to the first paid period following a trial and to every renewal, to monthly and annual Subscriptions alike, and whether or not you used the Services during the period paid for.

4.3 No refund for these reasons. In particular, no refund is due because: you forgot to cancel before a trial ended or a Subscription renewed; you did not use, or stopped using, the Services; you uninstalled the Software; you are dissatisfied with an Agent, an Output or a Third-Party Service; a Third-Party Service changed, became unavailable or raised its prices; your computer or operating system does not meet the requirements of the Software; or your access was suspended or terminated for breach of the Terms.

5. Cancellation

5.1 Any time. You may cancel your Subscription at any time, for any reason, from your account page at nonaai.ai or by writing to [email protected] from the email address of your Account.

5.2 Effect. Cancellation stops all future charges. It does not refund a charge that has already been made. After you cancel, your access to the Paid Features continues until the end of the billing period you have already paid for, and then ends.

5.3 Timing. To avoid being charged for the next period, you must cancel before the renewal date shown in your Account. A cancellation takes effect for renewal purposes when we or Paddle receive it.

5.4 What is not a cancellation. Uninstalling the Software, signing out, ceasing to use the Services, or removing or blocking your payment method does not cancel your Subscription.

6. No partial or prorated refunds

6.1 Part-used periods. We do not provide refunds or credits for a partly used billing period, including the unused part of an annual Subscription.

6.2 Downgrades. A change to a lower plan takes effect at the end of the billing period you have already paid for. No refund or credit is given for the difference in price for the current period. Your existing plan runs until it expires.

6.3 Non-use. No refund or credit is given for any period in which you did not use the Services.

7. Statutory right of withdrawal (European Economic Area and United Kingdom)

7.1 The right. If you are a consumer habitually resident in the European Economic Area or the United Kingdom, you have a legal right to withdraw from your Subscription, without giving any reason, within fourteen (14) days of the day on which the Subscription contract is concluded.

7.2 When the period runs. The Subscription contract is concluded on the day you start your free trial. At that time we tell you the price of the paid Subscription, the date of the first charge, and that the Subscription renews automatically until cancelled. The withdrawal period therefore runs during the free trial, in which no payment is taken, and ends when the trial ends. The right of withdrawal is given once, for the Subscription as a whole; it does not arise again when the trial converts to a paid Subscription or when the Subscription renews.

7.3 How to withdraw. To exercise the right, cancel from your account page or send a clear statement of your decision to [email protected] before the withdrawal period expires. It is enough that you send it before the period expires.

7.4 Effect of withdrawal. If any payment has been taken from you for a Subscription from which you validly withdraw, it will be reimbursed without undue delay and in any event no later than fourteen (14) days after we are informed of your decision, using the same means of payment you used, at no cost to you.

7.5 Service already supplied. By starting the trial you ask us to begin supplying the Services immediately, during the withdrawal period. If you withdraw after the Services have been supplied at your request, an amount proportionate to what was supplied up to the time you told us of your withdrawal may be retained, as the law permits.

7.6 Other countries. If you are a consumer in another country whose law gives you a right to cancel a subscription within a set period, that right applies to you as that law provides, and Sections 7.3 to 7.5 apply to it so far as that law allows.

8. If we end your Subscription

8.1 Without fault on your part. If we terminate your Subscription for a reason other than your breach of the Terms — including if we withdraw the Services or a plan — we will refund, on a pro rata basis, the fees you paid for the remaining portion of the billing period after termination. That refund is your sole remedy for such a termination.

8.2 For your breach. If we suspend or terminate your access because you have breached the Terms, you are not entitled to any refund, and any amount that had fallen due remains payable.

8.3 Suspension. A suspension of access under the Terms does not extend a billing period and gives no right to a refund or credit.

9. Charges made in error

9.1 What counts. A charge is made in error where, for example, you were charged twice for the same period, charged a different amount from the price shown to you, or charged for a renewal after a cancellation that had already taken effect.

9.2 What to do. Write to [email protected] within sixty (60) days of the charge, stating its date and amount. A charge confirmed to have been made in error will be corrected.

9.3 Unrecognised charges. If you see a charge you do not recognise, contact us first so that we can investigate it with you.

10. Payment disputes and chargebacks

10.1 Contact us first. Before raising a dispute or chargeback with your bank or card issuer, please contact us so that the matter can be reviewed. Most questions about a charge are resolved more quickly that way.

10.2 While a dispute is open. We cannot issue a refund for a charge while a dispute or chargeback about it is open, or after the amount has already been returned to you through that process.

10.3 Consequences. If you raise a dispute or chargeback that is not upheld, or raise one in bad faith or for a charge that is non-refundable under this Policy, we may suspend or terminate your access as the Terms provide and may decline to offer you a further Subscription. This does not limit any right you have to contact your bank or card issuer.

11. How to make a request

11.1 Where to send it. Send your request to [email protected] from the email address of your Account. You may also contact Paddle directly using the link in your order receipt.

11.2 What to include. State the email address of your Account, the date and amount of the charge, the invoice or order number if you have it, and the Section of this Policy on which you rely.

11.3 Review. We may ask for information reasonably needed to verify your identity and your request. A request does not itself cancel your Subscription; to stop future charges you must also cancel.

12. How refunds are paid

12.1 Original payment method. An approved refund is returned to the payment method you used. We do not pay refunds in cash, to a different account, or by any other method.

12.2 Timing. Depending on your bank or card issuer, a refund normally appears within five (5) to ten (10) business days after it is approved.

12.3 Amount. A refund is made in the currency of the original charge. We are not responsible for differences caused by exchange rates, or for fees charged by your bank or card issuer.

12.4 Effect on access. When a Subscription is refunded, the access paid for by the refunded charge ends at once, and Agents running under the Software are stopped as the Terms describe.

13. Misuse of this Policy

We may refuse a request, and may suspend or terminate access, where we reasonably believe that this Policy is being abused — for example, by repeated trials, repeated purchases followed by refund requests, false statements, or the use of more than one Account or payment method to obtain what this Policy does not allow.

14. Your legal rights

Nothing in this Policy excludes, restricts or modifies any right or remedy you have under consumer protection or other laws that cannot lawfully be excluded, restricted or modified. Where such a law gives you greater rights than this Policy, that law prevails to that extent, and the rest of this Policy continues to apply.

15. Changes; precedence

15.1 Changes. We may update this Policy from time to time, with notice of material changes as the Terms provide. The version in force when a charge is made applies to that charge.

15.2 Precedence. If there is a conflict between this Policy and the Terms on a matter of refunds, this Policy prevails. On every other matter the Terms prevail, including their provisions on disclaimers, limitation of liability, governing law and disputes, which apply to this Policy.
